Formal & Bridal Wear Consignment Agreement

TWICE AS NICE will determine the selling price of all items submitted for consignment based upon the age, condition, brand, style, size and product demand.
If client provides a receipt for the item(s), pricing can be discussed based on that. If no receipt is provided, then all items will be priced at the discretion of TWICE AS NICE.

All consigned items are subject to a price reduction at the discretion of TWICE AS NICE.

TWICE AS NICE agrees to pay the consignor 40 percent (40%) of the final sales price of any items, less any taxes.

This Consignment Agreement is based upon a twelve (12) month period. Either party may terminate this agreement by providing 10 days written notice to the other at the addresses listed in this agreement. Merchandise
picked up by the Consignor prior to the termination of this agreement will be subject to a $25.00 per item handling fee.

On the day after the Consignment Agreement ends, the Consignor has the option to pick up the remainder of the unsold consigned items, or they can choose to donate some/all items to TWICE AS NICE. It is the Consignors responsibility to contact TWICE AS NICE at the end of the consignment period, or periodically to check on the status of their account. TWICE AS NICE will NOT BE CONTACTING any consignors upon selling of their items. Any items NOT picked up within seven (7) days after the expiration date are automatically considered donated and become the property of TWICE AS NICE without further notice to the Consignor.

Options to renew Consignment Agreements are at the discretion of TWICE AS NICE. If a Consignor wishes to exercise an option to renew the contract, said option must be presented to TWICE AS NICE by the consignor before the last day of the Consignment Agreement.

It is the responsibility of the consignor to contact TWICE AS NICE to receive payment for sold items. Consignors can choose to contact TWICE AS NICE for payment when the consignment period ends or anytime throughout the contract as they wish. Once contacted, TWICE AS NICE will PAYOUT to the listed name of the Consignor in the Agreement within 10-20 business days at the address shown under the Consignor Contact Information. If any contact information has been changed, TWICE AS NICE will need to be notified before payout can be received.

TWICE AS NICE is a formal attire broker and cannot hold insurance for inventory it does not own. While TWICE AS NICE is very careful and trustworthy, it cannot assume any liability for fire, flood, theft, damage or wear. The Consignor understands the customers of TWICE AS NICE will handle and try on consigned items, therefore, the Consignor should expect to find reasonable wear and tear at the time of pick up of unsold items.

The terms and conditions outlined in this Agreement will remain in effect until further notice.

TWICE AS NICE, at his/her own discretion, may opt to return unsold items to Consignor at any given time.

This agreement can be terminated at any time by either the Consignor or TWICE AS NICE.

This Agreement is binding upon all parties, their heirs, executors, personal representatives, administrators and assigns. No person shall have a right or cause of action arising out of or result from this Consignment Agreement except for those who are parties to this Agreement and their successors in interest.

This Agreement, including any attached exhibits or addenda, constitutes the entire agreement of the parties. No representations or promises have been made except those that are set out in this Agreement. The Agreement may not be modified except in writing, signed by all parties.
